For the prevention of the mine hazard and efficient environmental protection for mining area, in May 2005, Mine Pollution Prevention and Reclamation Law was legislated. For the enforcement of the law, the drafts of related acts and regulations were prepared, and now, being examined by ministry of law. This article gives explanation of the main contents of the law, such as government responsibility, national plan for mine pollution control, mine pollution control programmes etc., and shows its application ways proposed by draft acts and regulations.
국내 가행광산 및 휴·폐광산에서 발생되는 광해로 인한 국토환경피해 및 국민보건의 위해 방지와 광해의 합리적 관리를 위해 2005년 5월 『광산피해의 방지 및 복구에 관한 법률』이 제정되었으며, 현재 부속 시행령 및 시행규칙 시안이 마련되어 법제처와의 협의가 진행 중에 있다. 본 논문에서는 상기 법률 및 부속 령, 규칙 등에서 명시된 광해방지 및 복구와 관련된 주요 내용으로서 광해방지 관련 국가의 책무, 광해방지계획수립, 광해방지사업의 시행체계, 광해방지사업금의 조성 및 용도, 광해방지시설의 검사와 유지관리 및 광해방지사업단의 기능과 역할 등을 살펴보았으며, 향후 보완이 필요한 주요 사항들을 지적하였다.
