Information
Korean mining law, since legislated in 1951, a lot of changes occurred in accordance with the variance of mining environment and social conditions. In 2010, Korean mining law revised again. This revised law show a lot of significant changes concerning the kinds of authorized minerals, mining rights and right durations etc.. In this thesis, through the review of the new articles on revised law, the expected effect and problems also described.
한국의 광업관련 법제의 기원은 대한제국 시절인 1895년 칙령 제94호로 반포된 사금개채조례(砂金開採條例)를 시작으로 하고 있으며, 한국전쟁 중인 1951년 법률 제234호로 대한민국 광업법이 탄생하게 된다. 국내 광업법은 국내 산업여건과 시대상황의 변화에 따라 많은 개정이 이루어져 왔다. 2010년 국내 광업법은 법정광물의 조정, 광업권리의 분리 및 권리의 제한을 비롯하여 몇 가지 중요한 개정이 있었으며, 개정 법률은 2011년 1월 발효되었다. 본 고에서는 국내 광업법의 변천과정을 정리하고, 금번 개정된 광업법의 주요 개정내용과 의의를 살펴보았으며, 개정 법률이 갖고 있는 문제점들에 대해 고찰하였다.
